Represented a global manufacturer of agricultural and industrial equipment as plaintiffs in a patent infringement litigation against two competitor-defendants. Served as damages team leader throughout the case. After a two-week jury trial, the jury determined that defendants infringed four patent claims, rejected all six of the defendants’ challenges to the patents’ validity and awarded client $16.3 million in damages for the first 2.5 years of the defendants’ infringing sales.
Teradyne, Inc. v. Astronics Test Systems, Inc. (C.D. Cal./P.T.A.B.): Won a complete victory for ATS and its parent company in a patent, copyright, and state law lawsuit concerning aerospace test instruments. Presented winning oral argument at an Inter Partes Review Hearing resulting in successful invalidation of all patent claims asserted against client Astronics by its competitor Teradyne. Won an initial motion to dismiss all of Teradyne’s claims as improperly pleaded and lacking personal jurisdiction; and a second motion to dismiss Teradyne’s indirect and willful patent infringement, unfair competition, and prospective economic advantage claims, as well as a motion to dismiss ATS’s parent company due to a lack of personal jurisdiction. Then, invalidated Teradyne’s automatic test equipment patent in an inter partes review proceeding. And finally, secured dismissal of Teradyne’s copyright claim as ATS’ copying for compatibility with pre-compiled computer programs was a fair use.
Argued and won partial motion to dismiss on behalf of client Amperex Technology against Semiconductor Energy Lab.
Won motion to dismiss in a multi-patent litigation against Epic Games concerning its messaging and communication technology. The court held that the Western District of Texas was an improper venue for the parties’ dispute.
Won appeals for a two-way radio industry leader at the U.S. Court of Appeals for the Federal Circuit, in which the Court affirmed the U.S. Patent and Trial and Appeal Board decisions upholding the validity of patent claims related to two-way radio technologies. The victory was highlighted in Law360.
Represented a two-way radio industry leader and won $764 million trade secret misappropriation and copyright infringement jury trial. The victory and Yimeng’s work was highlighted in The Am Law Litigation Daily’s “Litigator of the Week” feature, as well as reports from various outlets such as Bloomberg and Law360.
Represented a two-way radio industry leader in an ITC investigation resulting in a Determination and Exclusion Order preventing the defendant from importing its infringing products into the U.S.
