Patrick J. Gallagher
Overview
Patrick Gallagher is a litigation associate in the New York office of Kirkland & Ellis LLP. His practice focuses on complex civil litigation in federal and state courts across the country, as well as government and internal investigations. He has represented clients in a broad range of subject areas, including antitrust, securities, contract disputes and other commercial matters.
Prior to joining Kirkland, Patrick served as a law clerk to Judge Daniel A. Bress of the United States Court of Appeals for the Ninth Circuit and Judge John P. Cronan of the United States District Court for the Southern District of New York.

Representative Matters
Smartmatic USA Corp., et al. v. Fox Corporation, et al. (N.Y.): Counsel for Fox Corporation and Fox News, and certain of its on-air commentators, in a defamation lawsuit concerning Fox’s coverage of the 2020 Presidential Election.
Strategic Investment Opportunities LLC v. Lee Enterprises, Inc. (Del. Ch.): Counsel for Lee Enterprises and its board of directors in an expedited bench trial. Won complete verdict upholding Lee’s enforcement of its advance notice bylaw amid a hostile M&A bid by hedge fund Alden Global Capital. Won subsequent expedited matter defeating Alden’s request to enjoin Lee’s annual shareholder meeting.
Trial counsel for a hedge fund in a one-week AAA arbitration. Won favorable verdict.
In re Opana ER Antitrust Litigation (N.D. Ill.): Trial counsel for Impax Laboratories in a multidistrict class action litigation alleging an anticompetitive reverse payment arising out of a patent litigation settlement concerning the opioid pain medication Opana ER®.
Compagnie des Grands Hotels d'Afrique S.A. v. Starwood Capital Group Global I LLC, et al. (D. Del.): Counsel for Starwood Capital Group and certain affiliates in litigation seeking to enforce a foreign arbitration award pursuant to an alter ego theory of liability.
State of West Virginia v. Pfizer, Inc. et al. (W. Va.): Counsel for Sun Pharma and its subsidiary, Ranbaxy, in a litigation alleging an anticompetitive reverse payment arising out of a patent litigation settlement concerning the cholesterol medication Lipitor®.
In re Zetia (Ezetimibe) Antitrust Litigation (E.D. Va.): Counsel for Glenmark Pharmaceuticals in a multidistrict class action litigation alleging an anticompetitive reverse payment arising out of a patent litigation settlement concerning the cholesterol medication Zetia®.
Value Drug Co., et al. v. Takeda Pharmaceuticals U.S.A., Inc., et al. (E.D. Pa.): Counsel for Teva and Amneal Pharmaceuticals in a litigation alleging an anticompetitive conspiracy arising out of patent litigation settlements concerning the gout medication Colcrys®.
In re Ranbaxy Generic Drug Application Antitrust Litigation (D. Mass.): Counsel for Sun Pharma and its subsidiary, Ranbaxy, in a multidistrict class action litigation alleging fraudulent misrepresentations to the FDA and antitrust violations.
