Among other things, argued successful motion to exclude plaintiffs’ general causation expert in California state court coordinated proceedings.
Chicoine v. Wellmark: Represented for Wellmark Blue Cross Blue Shield in putative class action lawsuit alleging underpayment of chiropractic services. Argued successful opposition to class certification and successful defense on appeal to the Iowa Supreme Court. Plaintiffs voluntarily dismissed their claims after a hearing on Wellmark’s motion for summary judgment.
Jien v. Perdue Farms, Inc., et al.: Represented Sanderson Farms in putative class action alleging depressed wages as result of alleged antitrust conspiracy among poultry producers.
Fero v. Blue Cross Blue Shield Association: Represented Blue Cross and Blue Shield Association in putative class action alleging damages from alleged data breach of Excellus Health Plan. Argued successful defense of motion for class certification as to Blue Cross Blue Shield Association.
In re Blue Cross Blue Shield Antitrust Litigation: Represented Blue Cross and Blue Shield Association in multiple class actions challenging the Blue System’s exclusive geographic licensing system under the antitrust laws.
In re Testosterone Replacement Therapy Products Liability Litigation: Represented AbbVie in multidistrict products liability litigation related to a low-testosterone therapy. Tried bellwether case and received full defense verdict.
Bowman v. IBM: Represented IBM in class action alleging § 1983, negligence, and breach-of-contract claims against IBM and its subcontractors relating to IBM’s prior contract with the State of Indiana. Court excluded both of plaintiffs’ experts and denied motion for class certification in its entirety.
Land v. IBM: Represented IBM in lawsuit alleging § 1983 and negligence claims in connection with IBM’s prior contract with the State of Indiana. Successful dismissal of action on motion to dismiss. Argued successful defense of judgment on appeal before the Seventh Circuit.
Rohm and Haas Brain Cancer Litigation: Represented Rohm and Haas in multiple cases alleging brain cancer caused by asserted exposure to vinyl chloride. The first case, Branham v. Rohm and Haas, resulted in judgment for Rohm and Haas following an eight-week jury trial.
Dow Louisiana Groundwater Litigation: Represent Dow in class action lawsuits alleging property damage and medical monitoring claims from asserted chlorinated solvent exposure. Medical monitoring claims dismissed. Following an eight-week bench trial, Court adopted property damage remedy used by Dow.
Falkner v. IBM: Represented IBM in lawsuit challenging IBM’s involvement in the City of Chicago’s automated red-light camera program. Successful dismissal on motion to dismiss.
In re Hanford Nuclear Reservation: Represented corporation in mass tort litigation stemming from the manufacturing of plutonium for use in nuclear weapons. Allegations involve complex issues of scientific causation related to radioactive compounds and various diseases. All cases have settled following bellwether trials and voluntary and involuntary dismissals.
