Alyssa C. Kalisky
Overview
Alyssa Kalisky is a litigation partner whose practice focuses on complex commercial litigation, privacy litigation, as well as antitrust and competition matters. She has a broad range of litigation experience, spanning the industrial, insurance, pharmaceutical and retail industries. Alyssa has also advised and successfully represented many private equity clients and their portfolio companies in a wide range of disputes. She has litigated cases in various state and federal courts across the country, as well as in arbitration. Alyssa has helped clients obtain significant victories at the pleading stage, class certification and at trial, including a complete defense verdict in a nine-figure trade secrets trial.
In her data privacy practice, Alyssa’s Seventh Circuit win on an issue of first impression in a class action under the Genetic Information Privacy Act was highlighted in the National Law Journal and recognized by The American Lawyer in its “Litigator of the Week” series.
With respect to her antitrust work, Alyssa recently secured two significant wins in two different matters. In the first, the Iowa Supreme Court affirmed the lower court’s decision denying class certification in an antitrust conspiracy case brought by chiropractors against Iowa insurer Wellmark Blue Cross and Blue Shield. In the second, the Western District of New York denied plaintiffs’ motion for leave to amend their complaint, finding that plaintiffs had failed for the second time to plead that four pharmaceutical manufacturers had conspired under the Sherman Act, garnering another “Litigator of the Week” shout out.
In addition, Alyssa actively participates in Firm committees, diversity initiatives and recruiting efforts, including by serving as Co-Chair of the Summer Associates Program for the Chicago office. She has represented numerous pro bono clients and served as guardian ad litem, representing at-risk children and seniors throughout guardianship proceedings.

Representative Matters
International Rail Partners, LLC v. American Rail Partners, LLC et al.: Successfully represent defendants in expedited TRO and preliminary injunction proceedings brought by minority investor seeking to enjoin the sale of two short-line railroads.
Incyte Corp. v. Flexus Biosciences: Trial counsel for Flexus Biosciences, a Bristol-Myers Squibb subsidiary, in billion-dollar trade secrets misappropriation case. At the conclusion of a twelve-day trial, after the court eliminated several claims at summary judgment, the jury returned a unanimous defense verdict on all the remaining counts.
Mosaic Health, Inc. v. Sanofi-Aventis U.S., LLC et al.: Represent Eli Lilly in putative class action lawsuit alleging price fixing related to 340B discounts under federal and state laws.
In re BlueCross and BlueShield Antitrust Litigation: Represent Blue Cross Blue Shield Association, Wellmark, Triple-S Salud, and Hawaii Medical Service Association in putative, consolidated class actions brought by all Blue insureds and all healthcare providers challenging the structure of the Blue Cross Blue Shield system under the antitrust laws.
BIPA and GIPA Matters: Represent diverse range of clients in a variety of putative class actions brought under Illinois privacy statutes, including the Illinois Biometric Information Privacy Act and the Illinois Genetic Information Privacy Act. Representations have resulted in early dismissal as well as favorable settlement.
Successfully represent various private equity firms and their portfolio companies in both litigation and arbitration, including making Rep & Warranty insurance claims based on policies issued to insure risk of breach of purchase agreements.
