Emily Merki Long is a litigation partner in the Washington, D.C, office of Kirkland & Ellis LLP focused on complex commercial litigation. Emily’s practice spans a broad range of matters, including antitrust, breach of contract, fraud, securities fraud, contested bankruptcy proceedings, False Claims Act and data breach class actions. Emily also maintains an active pro bono practice.

Representative Matters
Trial Experience
- Florida v. Georgia (SCOTUS). Trial counsel for the State of Georgia in rare Supreme Court original jurisdiction suit related to equitable apportionment of the Apalachicola-Chattahoochee-Flint River Basin. Secured trial win before Special Master and ultimate 9-0 affirmance by SCOTUS.
- Alabama Aircraft Industries, Inc., et al. v. The Boeing Company (N.D. Ala.). Trial counsel for The Boeing Company in breach of contract dispute arising out of the United States Air Force’s award of a multi-year contract to Boeing.
- Intelsat v. SES (Bankr. E.D.Va.). Trial counsel for Intelsat in claims litigation related to FCC repurposing broadband spectrum.
Data Breach Litigation
- In re Marriott Int’l Inc. Customer Data Security Breach Litig. (D. Md., 4th Cir.). Counsel for Accenture LLP in multi-district litigation stemming from the Marriott data breach before both the MDL Court and the Fourth Circuit. Secured reversal of class certification.
- Counsel for Illuminate Education in class actions arising out of alleged data-security incident. Secured dismissal before federal and state lower courts; on appeal.
Antitrust/Other Government Enforcement
- Advised on multiple FTC enforcement actions for clients across a variety of industries.
- Counsel for Accenture LLP in False Claims Act case relating to the provision of software and related services to the Department of Defense and various military commands. Secured summary judgment on majority of claims.
