Mary Elizabeth Miller

Overview

Mary Miller is a litigation partner in the Washington, D.C., office of Kirkland & Ellis LLP. Her practice focuses on complex trial and appellate litigation in the federal and state courts, including matters involving contract disputes, fraud, and misappropriation of trade secrets. In 2022, Mary first chaired a six-day jury trial in federal court to successful verdict. Mary previously served as a law clerk to Justice Samuel A. Alito, Jr. of the Supreme Court of the United States, Chief Judge Priscilla Richman of the United States Court of Appeals for the Fifth Circuit, and Judge Richard J. Leon of the United States District Court for the District of Columbia.

Kaplan v. Carrier (D.N.J.). Counsel for Carrier in putative nationwide class action relating to product-liability issues.

AMO Dev., LLC v. Alcon LenSx, Inc. (D. Del.). Defended Alcon in a patent and copyright lawsuit concerning laser eye surgery technology, including winning summary judgment motions based on the copyright statute of limitations and related-J&J entities not being beneficial owners of the asserted works.

Alabama Aircraft Industries, Inc., et al. v. The Boeing Company (N.D. Ala.). Represented The Boeing Company in a dispute brought by a former Boeing subcontractor, alleging misappropriation of trade secrets arising out of the United States Air Force’s award of a multi-year contract to Boeing. In 2018, the court granted Boeing’s motion to enforce the damage limitation provision, eliminating over $100 million in damages.

Force v. Facebook. Represented Facebook in two related actions brought by Israeli citizens seeking damages under the Anti-Terrorism Act. Obtained affirmance of dismissal on appeal. This result was profiled in The American Lawyer.

Godwin v. Facebook. Represented Facebook in negligence action asserting failure-to-warn and wrongful-death claims. Obtained dismissal, and the result was affirmed on appeal.

Conduent Business Services, LLC v. Cognizant Business Services (NY). Represented Cognizant Business Services in a dispute alleging breach of contract and fraud.
