The Dow Chemical Company
- Stacey serves as National Counsel to The Dow Chemical Company in connection with asbestos-related personal injury and wrongful death lawsuits. As such, Stacey advises and coordinates with Dow local counsel across the country regarding strategy in defending such matters. In addition, she oversees discovery issues and participates in pre-trial and trial matters. Stacey has resolved a number of cases for Dow before or at trial in several jurisdictions including Texas, Louisiana, Illinois, Missouri, Washington and California. Recently, Stacey served as trial counsel in a wrongful death action seeking punitive damages and a $21 million compensation. After a three-week trial, the jury returned a defense verdict in Dow’s favor. Nichols v. AMF, Inc., et al., No. 1122-CC01820 (St. Louis, Mo, 2014).
Statutory Committee of Unsecured Creditors of Iridium LLC, et al. v. Motorola
- Since 2001, Stacey represented Motorola in a $4.3 billion case pending in the Southern District of New York. The case involved claims of fraudulent conveyance, breach of contract and fiduciary duty counts. Over the course of the litigation, Stacey developed key factual and legal defenses, deposed numerous witnesses, including a key third-party witness, drafted motions and examined trial witnesses. After a six-month trial on the bankruptcy claims, a complete verdict was entered in Motorola’s favor. This outstanding litigation victory was recognized by The American Lawyer as a “Big Suit” and also in its profile of the Kirkland & Ellis Litigation Department as The American Lawyer’s “2008 Litigation Department of the Year.”
In re Red Hat, Inc. Securities Litigation & Derivative Actions
- Stacey represented PricewaterhouseCoopers, LLP in Section 10(b) and Rule 10b-5 federal securities litigation, and in a related shareholder derivative action. PwC was dismissed from both lawsuits after filing and briefing motions to dismiss.
Conseco, Inc. / Bernstein v. Fred Alger Management Inc., et al.
- Stacey represented Conseco, Inc. in a MDL action involving federal securities claims in the United States District Court, District of Maryland. Conseco was dismissed from the action upon the granting of its motion to dismiss.
In re Combustion Engineering and ABB Lummus
- Stacey was part of the Kirkland team that represented ABB Ltd of Zurick in the asbestos bankruptcy of its United States subsidiary Combustion Engineering. In June 2006, the United States Bankruptcy Court entered an order confirming a complex pre-packaged reorganization plan.
In re The Babcock & Wilcox Company, et al., Debtors
- Stacey was part of the Kirkland team that provided strategic advice to B&W concerning its asbestos-related liabilities. In February 2000, B&W filed for Chapter 11 bankruptcy protection in the United States Bankruptcy Court for the Eastern District of Louisiana. In so doing, B&W became one of the first companies to invoke the procedures available under Chapter 11 to litigate the merits of its continuing asbestos-related claims. Stacey assisted in various aspects of Kirkland’s representation of B&W in the bankruptcy, including the successful defense of fraudulent transfer claims brought forth by the Asbestos Claimants’ Committee and the Future Claimants’ Representative.
