Litigator of the Week Runners-Up and Shout-Outs

Jay Lefkowitz, Cole Carter and Kristopher Morton received a shout-out for The American Lawyer Litigation Daily's "Litigator of the Week" for their work for the Association for Accessible Medicines.

"... Shout-out to Jay Lefkowitz and his team at Kirkland & Ellis representing the Association for Accessible Medicines, a trade group for generic and biosimilar drug makers, in a challenge to California’s AB 824. The law enacted in 2019 created a presumption that “reverse payment” settlements of patent infringement claims between brand-name and generic pharmaceutical companies are anticompetitive and unlawful. U.S. District Chief Judge Troy Nunley in Sacramento, who previously found the law violated the Dormant Commerce Clause, last week issued a permanent injunction barring the state from enforcing AB 824 on any settlement agreements except those “negotiated, completed, or entered into within California’s borders.” The Kirkland team also included of counsel Cole Carter, associate Kristopher Morton and their former colleagues Matt Rowen and Alexandra Russell."
