Trial counsel for iHeartMedia, Inc. and certain of its subsidiaries in their Chapter 11 restructuring and in contentious litigation with iHeart’s creditors, including a lengthy adversary proceeding relating to alleged “springing liens” sought by a creditor group that resulted in a key 2019 trial victory. iHeart also emerged from bankruptcy in 2019 following the closing of a complex series of transactions and settlements that were incorporated into its plan of reorganization. This was the largest Chapter 11 case filed in 2018 by funded debt.
Fort Benning Family Communities LLC, et al. v. American Management Services LLC, et al. (Super. Ct. of Muscogee County, GA); Monterey Bay Military Housing LLC, et al. v. American Management Services LLC, et al. (N.D. Cal.): Obtained historic settlement of nearly $200 million on behalf of Plaintiffs and the U.S. Army in a series of cases involving privatized housing at four military bases. The settlement resolved claims of fraud, breach of fiduciary duty and civil RICO against a third-party property management firm, and its chairman and CEO, and is the largest settlement or verdict of a RICO claim in Georgia.
Miller UK Ltd. v. Caterpillar Inc. (N.D. Ill.): Successful trial against Caterpillar Inc. in connection with Caterpillar’s breach of contract and theft of trade secrets, culminating in a $73.6 million verdict for Miller UK Ltd. The award in the five-year battle is believed to be the largest trade secret misappropriation verdict in Illinois history.
BankDirect Capital Finance, LLC v. Capital Premium Financing, Inc. (N.D. Ill): Counsel for insurance premium finance company in breach of contract and fraud litigation. Successfully obtained preliminary injunction after briefing and two-day evidentiary hearing.
