The Am Law Litigation Daily gave a shout out to a Kirkland team that achieved a win for client Six Flags in shareholder derivative litigation.
"...Shout out to a team at Kirkland & Ellis that got a ruling knocking out shareholder derivative litigation against Six Flags tied to allegations that the amusement park company misled investors about the financial health of its partner Riverside Investment Group Co. Ltd. and its prospects for building Six Flags parks in China. U.S. District Judge Mark Pittman in Fort Worth, Texas wrote in Wednesday’s opinion that to rush to court with a claim for failure of board oversight “after the announcement of a corporate trauma behaves contrary to the interests of the corporation.” The Kirkland team included Sandra Goldstein, Stefan Atkinson, Jeremy Fielding, and Dan Cellucci who previously knocked out a related securities class action against Six Flags in March."
