A trial team at Kirkland & Ellis helped client Carlisle Construction Materials beat back a case brought by Graco Inc. accusing the company of infringing a patent related to devices used to spray foam insulation in buildings. After an eight-day trial in Delaware federal court, jurors found last week that Carlisle did not infringe the asserted patent and that one of Graco’s claims was invalid due to prior art not fully disclosed to the patent office. The trial team was led by Kirkland’s Gregg LoCascio, Matt Owen, McClain Thompson, Nichole DeJulio and Meredith Pohl. The team had co-counsel including former Kirkland litigators Nathan Mammen and Cole Tipton, now at Snell & Wilmer, their Snell & Wilmer colleague Megan Carrasco, and Jack Blumenfeld and Anthony Raucci of Morris, Nichols, Arsht & Tunnell."
