Litigator of the Week Runner-Up and Shout-Outs

Diana Watral, James Hileman, Jason Feld, Nicholas Ruge and Elizabeth Kelly were recognized as runners-up for The American Lawyer's "Litigator of the Week" for their work for client Allergan. 

"... Diana Watral and her team at Kirkland & Ellis helped client Allergan score a rare defense summary judgment win in a False Claims Act suit in the Eastern District of Texas. The company was accused of engaging in a 15-year scheme to promote the off-label use of Botox to treat pediatric migraines and pay kickbacks to certain physicians considered key opinion leaders. But this week U.S. District Judge Rodney Gilstrap in Marshall found that the claims at issue couldn’t be false because they “explicitly disclose off-label Botox treatments for chronic migraine patents under 18 years of age.” The judge further found that the plaintiff could not show the speaking fees paid to key opinion leaders were for “sham” events or aimed at influencing referrals or prescribing decisions. The Kirkland team included partners James Hileman, Jason Feld, Nicholas Ruge and Elizabeth Kelly."
